The Code of Federal Regulations, accessible via the Electronic Code of Federal Regulations (eCFR), serves as an authoritative central reference for US regulatory requirements. Chemical substances in the United States are governed by a range of laws, including the Toxic Substances Control Act (TSCA), the Safe Chemicals Act, the Chemical Safety Improvement Act (S. 1009, CSIA), the Frank R. Lautenberg Chemical Safety for the 21st Century Act, and the TSCA Modernization Act of 2015 (H.R. 2576).
Following a 2009 announcement by the Environmental Protection Agency (EPA) to strengthen chemicals management legislation, a comprehensive programme was introduced, aimed at improving chemicals oversight by addressing the following priorities:
- Implementing new regulatory risk management measures.
- Developing Chemical Action Plans focused specifically on managing chemicals of concern.
- Requiring robust information to appropriately assess chemical risks.
- Making chemical information more accessible to the public.
- Involving stakeholders to prioritise chemicals for future risk management initiatives.
The Chemical Safety for the 21st Century Act, enacted in June 2016, requires the EPA to make affirmative determinations on new chemicals or significant new uses of existing chemicals before market entry. The EPA must determine that a substance:
- “Presents an unreasonable risk” and issue a section 5(f) order to mitigate such risks;
- Lacks sufficient information for a reasoned evaluation and issue a section 5(e) order;
- “May present an unreasonable risk” and issue a section 5(e) order;
- Or is “not likely to present an unreasonable risk” and subsequently publish the finding.
